AOC Speaks an Unspoken Truth and Targets the Activist Left on the US Supreme Court

US Rep. Alexandria Ocasio-Cortez (D-NY), has unwittingly opened the door to a process that few among us realize is at our disposal. The US Constitution makes it clear that justices of the United States Supreme Court can only serve during “times of good behavior,” which means they can be impeached during times of “bad behavior.”

Ocasio-Cortez called on US Supreme Court Justice Clarence Thomas to "resign" or be impeached after accusing him of failing to "disclose income from right-wing organizations” and insisting he “recuse himself from matters involving his wife, and his vote to block the January 6th commission from key information."

Ocasio-Cortez tweeted that the duty of Congress should be to look at Thomas' actions and launch an investigation to see if he should be impeached.

"Subpoenas, investigations, and impeachment should absolutely be on the table," she said in her social media posts. "We shouldn’t have to think twice about that. We must go where the facts take us. A failure to act puts the imperiling of democracy squarely on *our* shoulders. It’s our duty to defend it."

Thomas is under fire for texts recently unearthed between his wife, Ginni, and former President Donald Trump’s chief of staff, Mark Meadows, regarding the 2020 election and her belief the results were tainted.

Due to the nature of the texts, the unlegislated House January 6th Select Committee wants Ginni Thomas to testify before Congress.

Ocasio-Cortez is one of five Democrats calling on Justice Thomas, nominated to the high court by President George H.W. Bush in 1991 to replace retiring Justice Thurgood Marshall, to leave his seat.

"Congress must understand that a failure to hold Clarence Thomas accountable sends a loud, dangerous signal to the full Court – Kavanaugh, Barrett, and the rest – that his acts are fair game," Ocasio-Cortez said in another post on the thread. "This is a tipping point. Inaction is a decision to erode and further delegitimize SCOTUS."

Why This Is Important

Congresswoman (can we still use that term seeing as we aren’t biologists?) Ocasio-Cortez’s tweet not only validates what I have been explaining for years – that appointments to the US Supreme Court are not “lifetime” appointments, it unwittingly puts the far-Left activists on the US Supreme Court directly into the spotlight.

Article III, Section 1 of the US Constitution states, explicitly:

“The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.”

What Ocasio-Cortez has vocalized, proving that even a blind squirrel can find a nut from time to time, is that US Supreme Court Justices – as well as all federal bench judges – are subject to impeachment should they engage in “bad behavior” in an official capacity.

Of course, staining any elected or appointed official with the sins of spouses, children, secondary relations, or acquaintances is not engaging in “bad behavior,” so Ocasio-Cortez’s statements and demands are not applicable to a move to impeach Thomas.

The ridiculousness of Ocasio-Cortez’s rationale comes in the idea that because every member of the congressional Democrat Caucus – and indeed every member of Congress – associated with US Rep. Bobby Rush (D-IL) they should be labeled domestic terrorists. In 1969, Congressman Rush, then the leader of the Illinois Chapter of the Black Panthers, advocated for “offensive violence against the power structure.” He also served six months on a weapons charge in 1972. The former action jousts with the very definition of treason.

Claiming that Justice Thomas should face impeachment for “bad behavior” because of someone else’s statements or political leanings is just as ridiculous as saying Ocasio-Cortez and her fellow Democrats are domestic terrorists because Rush advocated for the violent overthrow of the government.

But Ocasio-Cortez does spotlight a valid point and one that I am certain her fellow Democrats – as well as the Left-leaning Justices on the US Supreme Court – wish she would have left unearthed.

According to the US Supreme Court’s website:

“The Court is the highest tribunal in the Nation for all cases and controversies arising under the Constitution or the laws of the United States. As the final arbiter of the law, the Court is charged with ensuring the American people the promise of equal justice under law and, thereby, also functions as guardian and interpreter of the Constitution...”

Because the primary and, in fact, exclusive role of a United States Supreme Court Justice is to act as a “guardian” of the Constitution – as well as the protector of the promise to “equal justice under the law,” acts of activism from those on the bench necessarily demonstrate “bad behavior” and, thus, open those activist Justices up to impeachment.

Ruling in favor of special interests violates the mandate of equal protection under the law and constitutes “bad behavior.”

Issuing rulings based on political ideology on cases before the court rather than on the constitutionality of the matter constitutes “bad behavior” because it abdicates the guardianship of the US Constitution.

“Legislating from the bench” (think Chief Justice John Roberts's horrendous opinion on Obamacare) violates the Separation of Powers and, thus, constitutes “bad behavior.”

Refusing to hear constitutionally-based arguments specifically cited in the Constitution itself (think: “...to Controversies between two or more States...”) using the never-mentioned-in-the-Constitution false flag of “standing” can also be argued as being seated during a time of “bad behavior.”

So, while Ocasio-Cortez’s fascist and constitutionally illiterate demand for Justice Thomas to resign from the bench or face impeachment must be considered ludicrous, there are grounds for impeaching several activist US Supreme Court Justices and many federal judges for their “bad behavior.”

Imagine that. Ocasio-Cortez could actually be the reason the US Supreme Court was purged of far-Left, ideologically-driven, fascist activists. Stranger things in Heaven and earth...
